1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Cloud Music iOS application ("App") provided by Cloud Music ("we", "us", or "our"). By installing or using the App you agree to these Terms. If you do not agree, please uninstall the App and discontinue use.
2. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on iOS devices that you own or control, solely for your personal, non-commercial purposes.
This license does not include the right to:
- Modify, reverse-engineer, decompile, or disassemble any part of the App;
- Redistribute, sublicense, or resell the App;
- Remove or alter any copyright, trademark, or proprietary notices.
3. User Responsibilities
You are solely responsible for:
- All music files and content you import, store, or play using the App;
- Ensuring you have the legal right to play, copy, or distribute any music file you use with the App;
- Keeping your cloud-service account credentials secure (Google Drive, Dropbox, etc.);
- Complying with all applicable laws and the terms of any third-party service you connect.
4. Intellectual Property & Copyright
Cloud Music is a tool for playing music you already own or are legally entitled to use. The App does not provide, stream, or distribute any copyrighted music content. You must not use the App to infringe any third party's intellectual property rights.
All intellectual property rights in the App (excluding user content) remain with us or our licensors.
5. Third-Party Services
The App integrates with third-party services including Google Drive, Dropbox, and ad networks. Your use of those services is governed by their respective terms:
We are not responsible for the availability, accuracy, or content of any third-party service.
6. In-App Purchases
The App offers an optional one-time in-app purchase to remove advertisements. All purchases are processed by Apple through the App Store and are subject to Apple's Terms of Sale. All sales are final except where required by applicable law. Refund requests must be submitted to Apple.
7. Prohibited Uses
You agree not to use the App to:
- Violate any applicable local, national, or international law or regulation;
- Infringe the intellectual property rights of any third party;
- Transmit any harmful, offensive, or unlawful content;
- Attempt to gain unauthorised access to any systems or networks;
- Interfere with the proper functioning of the App.
8. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Cloud Music be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of your use or inability to use the App.
Our total liability to you for any claims under these Terms shall not exceed the amount you paid for the App (if any) in the twelve (12) months preceding the claim.
10. Termination
We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms. Upon termination, the license granted to you immediately ceases and you must uninstall the App.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms. Continued use of the App after changes constitutes acceptance of the revised Terms. The "Last updated" date at the top of this page reflects the most recent revision.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts.
